2.1 Eligibility

• Services are provided for personal or professional use within Switzerland
• Accurate information must be provided during registration and consultation

2.2 Account Responsibilities

If account registration is required, you are responsible for:

• Maintaining confidentiality of account credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized access
• Ensuring your contact information remains current

2.3 Acceptable Use

Services are provided for lawful purposes only. You agree to use our services in compliance with all applicable Swiss and international laws.

All content on our website and within our services, including but not limited to:

• Software code and algorithms
• Design elements and user interfaces

Remain the property of Mindful Automation and are protected by Swiss and international copyright laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our services for personal or professional purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works.

4.3 User-Generated Content

Any data or content you provide through our services remains your property. However, you grant us a license to use this data solely for providing and improving our services as described in our Privacy Policy.

5.1 Service Availability

We strive to maintain service availability but cannot guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

5.2 Implementation

Service implementation requires home assessment and may take 1-2 days depending on the solution. Installation schedules are agreed upon during consultation.

5.3 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice to users.

5.4 Payment Terms

Payment is required according to the agreed service package:

• Prices are in Swiss Francs (CHF)
• Payment is due before or upon service delivery as agreed
• Accepted payment methods will be specified during consultation
• Invoices include all applicable taxes

5.5 Cancellation

Cancellation terms will be provided during service consultation. Cancellations made with insufficient notice may be subject to fees.

6.1 Service Warranty

Services are provided "as is" without warranties of any kind, express or implied. While we strive for high-quality service, we do not guarantee specific results or outcomes.

6.2 Technical Limitations

AI systems have inherent limitations. System performance may vary based on home configuration, network connectivity, and usage patterns.

6.3 Limitation of Liability

To the fullest extent permitted by Swiss law:

• Our liability is limited to the fees paid for the specific service
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for losses resulting from user error or misuse
• We are not liable for third-party equipment failures

6.4 User Responsibility

Users assume risk for service use and are responsible for ensuring compatibility with their home environment and needs.

7.1 Informal Resolution

We encourage users to contact us first to resolve any disputes informally. Most concerns can be addressed through direct communication.

7.2 Mediation

If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing legal action.

7.3 Jurisdiction

These terms are governed by Swiss law. Disputes shall be resolved in the courts of Zürich, Switzerland.

7.4 Applicable Law

Swiss law applies to these terms and your use of our services, excluding conflict of law principles.

8.1 Termination by User

Users may terminate services with appropriate notice as specified in service agreements.

8.2 Termination by Us

We may terminate or suspend access immediately for violations of these terms or harmful conduct.

8.3 Effects of Termination

Upon termination, your right to use our services ceases. Certain provisions of these terms, including intellectual property rights and liability limitations, survive termination.

10.1 Entire Agreement

These terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Mindful Automation.

10.2 Severability

If any provision of these terms is found invalid or unenforceable, remaining provisions continue in full effect.

10.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision or our rights.

10.4 Assignment

You may not assign or transfer these terms without our written consent. We may assign our rights and obligations without restriction.

10.5 Force Majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, government actions, or infrastructure failures.
